Interim Application has been preferred for bringing on record the legal heirs of deceased Appellant No.1 and for condonation of delay of 39 days caused in filing the Application. 2.
Pursuant to the orders passed by this Court, an additional affidavit has been filed wherein it is stated that though the Appeal was drafted within time, the same could not be filed as Applicant's mother was seriously ill and had to be hospitalised and thereafter there was some oversight on the part of Advocate by reason of which there was Patil-SR 1 of

Learned Counsel appearing for the Respondents would oppose the Application and would submit that there is no sufficient explanation for delay.

The additional affidavit sufficiently explains the delay of 39 days and therefore delay is condoned. Interim Application stands allowed.
