We permit the intervention of this applicant, who is represented by Mr. Sakhare, learned senior counsel. He states that the entire contract as awarded to his client stands exhausted as also his client has received 90% of the payment under contract. In view of this, Mr. Sakhare's contention is that the petition is rendered infructuous.

Let such affidavit be placed on record on or before the returnable date and copy of the same be furnished to all the parties. Considering such affidavit, we shall pass further appropriate orders.
