CORAM : BHARATI DANGRE & MANJUSHA DESHPANDE, JJ DATED : 2nd FEBRUARY, 2026 (In Chamber) P.C:- As directed by the earlier order, the respondent along with his counsel is present in the Chamber. The appellant/applicant could not remain present, but she is represented by her father and her Advocate.
During the course of hearing, father and the Advocate representing her, based on the medical papers submit that she is
2/3 IA 15620-24.doc suffering from hemiparesis and two prescriptions of the medical practitioner Dr. Anand G. Gore, MBBS, M.D. (Medicine) University of Mumbai, India, a Consultant Physician, are placed before us.
One prescription is of 16/12/2023 and when we specifically insisted that the latest report should be placed before us, prescription of 20/6/2025 on the letter head of Dr. Anant Gore is placed before us.
We are surprised to note that both the prescriptions are almost identical with the same medicine prescribed and we are really wonder as to whether for years together, the Doctor can prescribe the same medicine.
In any case, we do not intend to have any doubt about the medical condition of the appellant, but the aforesaid prescriptions have created a doubt in our mind and therefore, we request the appellant to get a certificate from Dr. Anant Gore about the present physical condition of the patient and whether she has recovered and what is the extent of her disability on account of the alleged paralysis/stroke suffered by her.
We expect the Doctor to give his opinion and the same shall be placed before us, based on her history, medical treatment, as it is the contention of the appellant that consistently she is under treatment of Dr. Anant Gore. We make it clear that if we are not satisfied with the said report, we would appoint a team of expert doctors or forward
3/3 IA 15620-24.doc the applicant to any Government Hospital where she could be examined and her health card be placed before us. In the mean time, we also direct the respondent to make his offer of amount to be paid to the appellant by way of full and final settlement and definitely, a dignified amount, which will cater to her and specifically if it is found that if she is suffering, then take care of her ailment too. Let the necessary certificate be produced from Dr. Anant Gore be produced before us on the next date of hearing. List on 13/2/2026 on Supplementary Board.
