The learned Advocate for the Appellants has filed this Interim Application No.15627 of 2024 for deleting the name of Appellant No.2.

On perusal of application and after hearing learned Advocate for the Appellant, it emerged that death of Appellant No. 2 has been occurred. The Appellant Nos. 1, 3 and 4 are the brothers of deceased Appellant No. 2 - Muktabai A. Patil. Except Appellant Nos. 1, 3 and 4, there are no other legal representatives or heirs of deceased Appellant No.2. Therefore, the Appellants prayed to delete the name of Appellant No.2 from the Appeal.

In view of above following order is passed :-

(1) The Interim Application No. 15627 of 2024 is allowed and Appellants are permitted to delete the name of deceased Appellant No. 2.

(2) Learned Advocate for Appellants shall delete the name of Appellant No. 2 by carrying out necessary amendment and shall file amended copy of Petition within two weeks (excluding Christmas Vacation).
