The present First Appeal impugns the order and judgment dated th November 2023 passed by the Commissioner for Employees Compensation and Judge 5 th Labour Court, Mumbai. In Application (ECA) No.76/B-15 by which the Trial Court has directed payment of compensation of Rs.23 Lakhs to the heirs of the deceased Ramesh S. Tholar. The Respondent is the wife of late Ramesh S. Tholar. Mr. Khan submits that the Appellant has deposited the entire Ajit
2 504-FA(ST)35575-2024.doc amount of compensation awarded i.e. Rs.23 Lakhs before the Trial Court. His statement is accepted. Having due regard to this fact and also the facts which the Respondents are today served and had not appeared, I deem it fit and appropriate to grant a stay on execution till the next date. 2.
