The Interim Application seek modification in the order dated 18th November, 2024, to the effect that the directions which are issued for passing of the award by CGIT1 Mumbai shall be substituted by CGIT-2, since in the Application, a specific statement is made in paragraph No. 3 to the effect that Justice Vikas Kunwar Srivastava (Retd), Presiding Officer of CGIT, New Delhi who was functioning CGIT-1, Mumbai has demised on 4th December, 2024. 8-IA-16189-2024.odt A statement is made in the Petition that there is another CGIT-2 Mumbai in the same premises and the Presiding Officer is one Shri. Shrikant Deshpande. It is therefore prayed through the Interim Application that the directions passed by this Court 18th November, 2024 directing the CGIT, incharge of CGIT-1 Mumbai to deliver the award to be read as directions to CGIT2. 2.
Considering the innocuous prayer and accepting the statement made in the Interim Application, we direct that the direction issued in our order dated 18th November, 2024 shall be read as a direction issued to CGIT-2. However, since we are modifying the order we deem it appropriate that pursuant the written submissions being furnished, the CGIT-2 shall deliver the award on or before 31st March, 2025.
By modifying the order dated 18th November, 2024 to the aforesaid extent, the Interim Application is disposed off.
