On instructions, he seeks withdrawal of the appeal, on the ground that now the co-accused is already released on bail by the learned Special Court and the appellant seeks parity with the co-accused and therefore, he be permitted to withdraw the appeal with liberty to file before the learned Special Court. 2.

The application is disposed of as withdrawn with liberty to file before the learned Special Court. 3.
