By this application, the applicant seeks transfer of Criminal M. A. No.2790/2023 pending on the file of 18th Joint Civil Judge, Senior Division, Nagpur to the file of the Family Court, Nagpur.

The contention is that the non-applicant has filed Marriage Petition No.A/907-2023 pending on the file of Family Court, Nagpur on the same set of fact on which the application under Section 125 of the Domestic Violence Act is to be filed before the learned J.M.F.C. According to him, there is possibility of passing conflicting orders on the same set of fact.
