By the present interim application, the applicant seeks permission to travel abroad from 18 August 2025 to 1 December 2025. The applicant has been granted anticipatory bail in connection with CR No.169 of 2016 registered at Khar Police Station, Mumbai, for offences punishable under Sections 328, 323, 504 read with Section 34 of the Indian Penal Code.

The learned Counsel for the applicant submits that the present FIR has arisen out of marital disputes between the applicant and the respondent. The applicant seeks permission to travel abroad from 18 August 2025 to 1 December 2025, for the purpose of accompanying her daughter in connection with her education and for attending to her own medical treatment. The learnd Counsel further submits that the applicant has, on 17 prior occasions travelled abroad with the leave of this Court while on pre-arrest bail and has, on each occasion, duly complied with the conditions by returning to India within the stipulated time. The learned Counsel submits that the applicant undertakes not to seek any adjournment before Page No. 3 of 5
Chitra Sonawane 2-IA-2353-2025.doc the family Court on the ground of her travel, and that the proposed travel will not cause any prejudice to the the respondents.

The learned APP and the learned Counsel for respondent No.2 state that they have no objection to the applicant travelling abroad during the aforesaid period, subject to the applicant complying with the conditions imposed by this Court.

Upon review of the records, it is evident that this court has previously granted the applicant permission to travel abroad on 17 occasions, with the applicant consistently returning to India as required. Considering the peculiar facts of the case, the interim application is allowed in the following terms :
(i) The applicant is permitted to travel out of India from 18 August 2025 to 1 December 2025.
(ii) The applicant shall submit her travel itinerary, details of intended stay, and contact information to the investigating officer.

Chitra Sonawane 2-IA-2353-2025.doc (iii) The applicant shall furnish an undertaking to the Registry of this Court that she will return to India during this period.
(iv) The investigating officer shall immediately return the passport to the applicant to enable her to travel and obtain necessary permissions.
(v) The applicant shall re-deposit her passport with the investigating officer within one week after her return.

The interim application stands disposed of accordingly. Criminal Application No.53 of 2024 :
