Heard learned counsel for the applicant.

Having heard the learned counsel for the applicant and considering the chronology of events, prima facie, there appears to be substance in the contention raised on behalf of the applicant that bail could not have been granted again to respondent No.2, considering the facts and circumstances of the present case.

Issue notice to the respondents. Mr. Khan waives notice on behalf of respondent No.1-State. Notice shall be returnable on 26.08.2024, High on Board.

The notice shall be served additionally through the investigating officer for which purpose, the applicant shall provide an additional set of papers to the investigating officer.

At this stage, the learned counsel for the applicant submits that respondent No.2 has been served privately and that the affidavit of service is ready. The same is taken on record.
