Heard Mr. Deshpande, learned Counsel appearing for the Applicant and Mr. Rankhambe, learned Counsel appearing for Respondent No.2.

In the present Criminal Application filed under Section 407 of the Code of Criminal Procedure, 1973 the following relief is sought :- "(a) This Hon'ble Court may be pleased to pass order directing the learned Principal Judge, Family Court, Akola to transfer the papers and proceeding in E Petition No. 119/2023 to the Family Court at Pune."

After arguing the matter for some time, both the learned Counsel, on instructions, submit that, by consent, prayer clause (a) be granted.
03-APPLN-71-2024.doc Both the learned Counsel state that the said statement is made on instructions of the Applicant and Respondent No.2, who are personally present in Court.

However, Mr. Rankhambe, learned Counsel appearing for Respondent No.2, states that as and when the Respondent No.2 is required to travel to Pune to attend the said E Petition No.119 of 2023, an amount of Rs.8,000/- per visit shall be directed to be paid by the Applicant - Amit Prakash Chavan. Mr. Deshpande, learned Counsel appearing for the Applicant, on instructions of the Applicant, states that the Applicant is ready to pay the said amount. The said amount is to be paid at least 3 days in advance before the scheduled date. The said statement made by the Applicant is accepted as undertaking given to this Court.

The Applicant also to pay cost of Rs.25,000/- to the Respondent No.2 within a period of one month from today for the purpose of engaging a new Advocate after the transfer of said Petition before the Family Court.

Accordingly, the Criminal Application is allowed in terms of prayer clause (a), subject to above.
