By this application, the applicant is seeking relaxation of condition which is imposed by the Additional Sessions Judge, Nagpur while releasing the applicant on bail vide order dated 13/12/2023.

Learned Counsel for the applicant submitted that by this order the applicant/accused was directed to attend the police station Mankapur, Nagpur on First and Third Monday of each and every month in between 11.00 a.m. and 12.00 p.m. for one year and thereafter on first Monday of each and every month for four years or till conclusion of the trial, whichever is earlier. But while relaxing the condition, the Sessions Court has directed the applicant to attend the concerned police station on every Sunday between 11.00 a.m. and 12.00 noon. He submitted that as far as the attendance of the applicant which is required, the applicant is ready to attend the Crime Branch as further investigation is carried out by the Crime Branch. He submitted that even whenever his presence is required, the applicant is ready to attend the Crime Branch. In case any notice of 10 days in advance

Learned APP and the Investigating Officer both have submitted that his presence once in a month on any working day will suffice the purpose.

After hearing the learned Counsel for both the parties. Perused the application as well as the earlier order passed. Considering now the investigation is with the Crime Branch though charge-sheet is filed. The condition imposed by the Sessions Court is modified as follows: (i) The applicant shall attend the concerned police station on 2nd Saturday of every month and the Investigating Officer shall record his presence and the applicant shall cooperate with the investigating agency. (ii) The Investigating Officer is at liberty to send a notice 10 days in advance if she requires his presence for the investigation purpose.

(iii) In addition to that, the applicant shall attend the nearest police station at Jabalpur on every Sunday.

(iv) The applicant shall also give his mobile number, address along with address proof, e-mail address and the WhatsApp number before the investigating agency.
