By this application transfer of the case filed by respondent No.2 under the provisions of Protection of Women from Domestic Violence Act bearing No. 266/DV/2019 pending on the file of learned Magistrate at Vasai is sought to the Court of Magistrate at Dadar (Sewri), where two cases filed by the applicant No.1 against respondent No.2 are pending. 2.

I have heard the learned counsel for applicants and 1/3

learned counsel for the Respondent No.2.

The learned counsel for the applicants submits that the respondent No.2 is the daughter-in-law of the applicant No.1. It is submitted that the applicant No.1 is a senior citizen and it is difficult for her to attend the matter at Vasai. It is submitted that no inconvenience will be caused to respondent No.2 as she is appearing in two matters filed by applicant No.1 in the Court at Dadar (Sewri). It is submitted that the matter filed by the respondent No.2 be therefore transferred to the Court at Dadar (Sewri).

On the other hand, the learned counsel for the respondent No.2 submits that the respondent No.2 is working and it will be difficult for her to prosecute her case if transferred to the Court at Dadar (Sewri) as on every date she has to take leave. 5.

The fact that the applicant No.1 is a senior citizen is not disputed. Admittedly, respondent No.2 is appearing in two cases filed by the applicant No.1 in the Court at Dadar (Sewri). In that view of the matter, prayer as sought is granted. The Magistrate's 2/3

Court at Vasai shall transfer the case bearing No. 266/DV/2019 filed by the respondent No.2 to the Court of the Metropolitan Magistrate 5th Court at Dadar (Sewri), Mumbai, where two case filed by the applicant No.1 bearing Nos. 1/DV/2018 and 315/SS/2019 are pending.
