The proceedings of which transfer is sought in the present Application were the subject matter of Cri. Writ Petition (St.) No. 2146 of 2024. By Order dated 07.05.2024, this Court (Coram : Sharmila U. Deshmukh, J.) directed the said proceedings to be decided expeditiously on a request made by the parties for deciding them in a time bound programme. It was also observed in that order that arrears of maintenance was to be paid within a period of ten weeks from the date of the said Order, but I am informed across the bar by Mr. Menezes, learned Advocate for the Respondent No. 2 that a sum of Rs. 1,50,000/- is still outstanding. Considering the above facts and in the above circumstances, I do not propose to pass any Order at present, as I am not aware whether any extension has been granted to the learned Magistrate to complete the hearing in the D. V. proceedings also. Parties shall inform the Court about the next date of hearing and status of the matter. Thereafter, the present Application for transfer shall be heard and decided on its own merits.
