Date : 12 July 2024 P.C. :
Heard Mr MA Adenwala, the learned Counsel appearing on behalf of the applicant; Mr CD Mali, the learned Additional Public Prosecutor representing the respondent No.2/ State and Mr Roshan Hule, the learned Counsel for the respondent No.1. 2.
The respondent No.1 was granted pre-arrest bail in CR NO.433 of 2024, registered with Khadakpada Police Station, Thane, for offences punishable under Sections 498-A, 323, 504 and 506 of the Indian Penal Code.
3.
The applicant herein, who is the first informant requested the cancellation of pre-arrest bail for respondent No.1/accused. The ground for this request includes concerns that respondent No.1 threatened the applicant and the witnesses. 4.
Upon reviewing the records, it is evident that the learned Sessions Judge granted anticipatory bail to the applicant on 13.05.2024. There is no material to suggest that respondent No.1
engaged in actions that terrorised the applicant and/or the witnesses. Furthermore, at this stage, when the investigation is on the verge of completion, there is no justification for entertaining an application to cancel pre-arrest bail. 5.
Accordingly, the present application stands rejected. (R.N. Laddha, J.)
