Heard learned Advocate for the Petitioner - husband. The Respondent-wife has filed proceeding as per the provisions of Protection of Women from Domestic Violence Act, 2005 and it is pending before the Court of Metropolitan Magistrate at Borivali. Whereas, the Divorce Petition filed by the wife and Restitution Petition filed by the husband are pending before the Family Court - Mumbai.

The husband wants transfer of Domestic Violence proceeding to Satish Sangar 1/2

901-APPLN-194-2024.doc the Family Court. Notice was issued but report is awaited. The wife is served by way of private notice. Affidavit be filed in the Office. 3.

Let, matter be kept on 9th October 2024.

The Petitioner is at liberty to issue fresh private notice additionally. The Petitioner is directed to file one Application before the Family Court thereby bringing it to the notice of the Court and the wife that this Transfer Petition is filed and it is fixed on 9th October 2024. Its copy be given to learned Advocate for the wife. After this intimation, if the wife wants to appear, she can appear before this Court. If, she will not appear, then Court will decide this Application on the basis of available record.
