The Respondent-wife has filed the Petition for divorce before the Family Court at Bandra. The Petition filed by the Applicant-husband for custody of a child is also pending before the Family Court at Bandra. 2.
By this Application, the Applicant-husband is seeking transfer of Applications filed by the Respondent-wife under Section 125 of the Code of Criminal Procedure and under the Protection of Women from Domestic Violence Act, 2005, from the Court of Judicial Magistrate, Mazgaon, where they are at present pending, to the Family Court at Bandra. 3.
I have heard the learned counsel for the parties. 4.
In the facts and circumstances, it would be expedient to transfer the matters pending on the file of Magistrate, to the Family Court at Bandra. Mugdha
2 27-APPLN 213-24.doc The present Application is thus allowed. The learned Magistrate shall transfer Misc. Cases/587/2022 and DV Cases/103/2022 to the Family Court, Bandra.
