The essential challenge in the present application is to an order passed by the Sessions Judge rejecting the applicant's request for relaxation of a condition. Consequently, the appropriate remedy for the applicant is to invoke the judicial review jurisdiction of this Court, which is not available under Section 439 of the Code of Criminal Procedure, 1973. Hence, all questions raised in the application are kept open to be agitated in an appropriate application.
