By the present Application, the Applicant has sought for cancellation of bail granted to Respondent No. 2-Janabai Bira Solankar, by the Additional Sessions Judge, Sangli, by its order dated 28th April 2023 passed in Criminal Bail Application No. 389 of 2023 in connection with Crime No. 136 of 2023, registered with Jat Police Station, Sangli.

Mr. Sachin Hande, learned Advocate for the Applicant submits that the ground on which the Applicant is seeking cancellation of bail, is that Respondent No. 2 while applying for bail, had made a statement that she is 70 years of age. He submits that factually Respondent No. 2 was 54 years of age. He therefore Gitalaxmi

901-APPLN-354-2024.doc submits that there was misrepresentation on the part of Respondent No. 2.

I have perused the records with the assistance of Mr. Sachin Hande, learned Advocate and Mr. Tanveer Khan, learned A.P.P. 5.

Perusal of the order dated 28th April 2023, passed in Criminal Bail Application No. 389 of 2023 reveals that the Additional Sessions Judge, Sangli had considered merits of the Bail Application. Paragraph Nos. 8 and 9 of the order records the reason for granting bail.

Age of Respondent No. 2 does not appear to be a consideration in the order dated 28th April 2023, for grant of bail. In such circumstances, there is no merit in the ground raised by the Applicant herein.

In view of the above, Criminal Application No. 354 of 2024 is dismissed.
