Heard Mr. Vivek Punjabi, learned Advocate for the Applicant, Ms. Veera Shinde, learned A.P.P. for the State/Respondent and Mr. Satyajeet Dighe, learned Advocate for Respondent Nos. 3 and 4. 2.

By the present Application, the Applicant is seeking cancellation of bail granted to Respondent Nos. 3 and 4 (Accused Nos. 1 and 2) vide order dated 29th February 2024 passed in Criminal Bail Application No. 425 of 2024, in connection with Crime No. 119 of 2024 registered with Ambad Police Station, Nashik.

After having heard the matter for some time and upon this Court having expressed its view of not being inclined to entertain the present Application, Mr. Vivek Punjabi, learned Advocate for Gitalaxmi

17-APPLN-395-2024.doc the Applicant on instructions from the Applicant craves leave to withdraw the present Application with liberty to file an appropriate Application before the learned Trial Court in the event Respondent Nos. 3 and 4 commit breach of the bail conditions imposed on them vide order dated 29th February 2024 passed in Criminal Bail Application No. 425 of 2024.

Applicant is always at liberty to file an appropriate Application seeking cancellation of bail in the event of Respondent Nos. 3 and 4 commit breach/violation of the bail conditions imposed on them by the Additional Sessions Judge, Nashik vide order dated 29th February 2024 passed in Criminal Bail Application No. 425 of 2024. In the event any such Application is filed by Respondent Nos. 3 and 4 before the learned Trial Court, then the same shall be considered on its own merits and in accordance with law.
