The applicant is accused in Crime No. 616 of 2023 registered at Vairag Police Station, District : Solapur (Rural) for the offences punishable under Sections 354, 354-B, 326, 325, 324, 323, 147 & 504 of the Indian Penal Code and punishable under Sections 8, 12 & 42 of the Protection of Children from Sexual Offences Act (POCSO). 2.

The Sessions Court by order dated 06.02.2024 while releasing the applicant on bail has imposed the following condition :

7-APPLN-418-2024.doc (c) Applicant / accused shall not enter in Barshi, Taluka, Dist. Solapur wihtout prior permission of this Court.

The application was filed before the Sessions Court seeking relaxation of the above condition. The learned Sessions Court while rejecting the application has recorded the following findings:

On perusal of entire proceeding more particularly say of I.O. and C.C.T.V.

footage filed by I.O. and say of victim it appears that in spite of condition imposed against the present applicant in Cri.Bail Appln.No.4/2024, dated 06/02/2024, eventhough applicant entered in Barshi Taluka. C.C.T.V. footage filed on record in which accused in shown in one shop of Vairag after passing order dated 06/02/2024. So, the reason shown by the applicant for relaxation of condition is not just and proper. On the contrary, he committed breach of said terms of bail order".

In view of above finding, I am not inclined to entertain the present application filed by the applicant seeking relaxation of the condition in question. The application is rejected.
