The applicant is accused in Crime No.20 of 2023 registered at Cyber Police Station, Dist.- Pune, for the offences punishable under Sections 408, 419, 420, 201, 120B and read with Section 34 of the Indian Penal Code and Sections 43, 66, 66 (D) of the Information Technology Act.

The Sessions Court while releasing the applicant on bail has imposed the following condition :

" e) The applicant/accused shall not leave District Pune without prior permission of Ld. Trial Court till conclusion of trial."

The learned counsel for the applicant submits that the applicant is resident of State of Jharkhand and his mother is residing there. It is submitted that the mother of the applicant is suffering from various ailments and there is nobody to take Zeenat Pathan

13-APPLN-451-2024.doc care of her. It is submitted that the applicant is ready to attend the concerned Police Station once in a three months. 4.

On the other hand, the learned A.P.P. for the Respondent-State submits that considering the fact that the applicant is resident of State of Jharkhand, the condition in question was imposed. It is submitted that the condition in question may not be relaxed.

There are no other criminal antecedents against the present applicant. For the reason stated in the application, I am inclined to relax the condition in question. The condition imposed by the Sessions Court that the applicant shall not leave the District Pune without prior permission of the Ld. Trial Court, is hereby relaxed.

The applicant shall attend the concerned Police Station once in a three months till conclusion of the trial. 7.
