This criminal application essentially on the ground that the order passed by the Trial Court rejecting applicant's application for cancellation based on supervening events or breach of conditions imposed by the Trial Court. In such case, the remedy available for the applicant is to invoke revisional or writ jurisdiction of this Court, and not jurisdiction of this Court under Section 439(2) of the Criminal Procedure Code, 1973 which operates in totally independent sphere.

Hence, by permitting the applicant to challenge the impugned order by way of revision or writ, the present criminal application stands disposed of.
