In this Criminal Application filed under Section 407 of the Code of Criminal Procedure, 1973/Section 447 of the BNSS, 2023, the Applicant, original Informant/Complainant, has sought transfer of ABA No.2076 of 2024 from the Court of learned Additional Sessions Judge, Thane at Kalyan, who is presently hearing the matter, to any other Additional Sessions Judge, Thane at Kalyan. 2.

Heard Mr. Upadhyay, learned Advocate appearing for the Applicant for some time.

Learned APP seeks time to take instructions and to file Affidavit. Let such Affidavit be filed within two weeks. 4.

Even after this Order is dictated in open Court, Advocate Mr. Upadhyay continues arguing the matter. This conduct of the learned Advocate is not proper and if this conduct is repeated then the Court will be constrained to withdraw the facility of hearing through V.C. in this matter.
