After hearing the learned Senior Advocate appearing for the Applicant for some time, he, upon instructions from the Applicant, seeks leave to withdraw the application. He submits that the informant and the witnesses are not attending the learned Trial Court and, therefore, the trial is being prolonged, though the matter is posted for recording evidence. He submits that the Applicant is a Government servant and, due to the pendency of the case, his promotion is held up. He further submits that the learned Trial Court be directed to expedite the trial and conclude the same within a time-bound period. 2.

In view of the above submissions, the application stands disposed of as withdrawn.

In case the Applicant makes an application before the learned Trial Court to expedite R.C.C. No. 398 of 2024, the same shall be considered by the learned Trial Court, considering all aspects of the matter and the pendency of cases in the Court. 4.

The fee of the learned Advocate Ms. Pooja Kishor Apache, appointed to represent Respondent No. 2, is quantified at Rs. 5,000/- (Rupees Five Thousand only) to be paid by the High Court Legal Services Sub Committee, Aurangabad Bench.
