Respondent No. 2 lodged a report with Osmanpura Police Station against her husband and in-laws. Pursuant thereto, Crime No.0165 of 2023 came to be registered for the offences punishable under Sections 498A, 323, 504, 506 read with Section 34 of the Indian Penal Code, 1860. Upon completion of the investigation, a charge-sheet came to be filed. The Applicants are Accused Nos. 4 and 5. 3.

Heard the learned Advocate for the Applicants, the learned APP for the State, and the learned Advocate for Respondent No. 2. 4.

The Applicant No. 1 is the brother-in-law of Respondent No. 2, and Applicant No. 2 is the wife of Applicant No. 1. The affidavit of

2 905APPLN1546.2024.odt Respondent No. 2 is tendered across the bar by the learned Advocate for Respondent No. 2. On going through the said affidavit, it appears that the parties have arrived at an amicable settlement and have entered into a compromise. Respondent No. 2 has stated in the said affidavit that the application be allowed and the proceedings be quashed. The said affidavit is taken on record and marked as "X" for identification purposes.

It appears that the settlement has been arrived at before the Family Court, where the divorce proceedings are pending. Considering the nature of the offence and the mutual settlement and compromise between the parties, the proceedings are hereby quashed in exercise of the powers vested in this Court under Section 482 of the Code of Criminal Procedure. Hence, the following order:

ORDER

[i] The Application is allowed.

[ii] Crime No. 0165 of 2023 registered with Osmanpura Police Station and the consequential charge-sheet bearing R.C.C. No. 2020 of 2024 against the Applicants is hereby quashed and set aside.
