The applicant in this application in para No.5 has made following contentions :

"5. As stated forgoing paragraphs, now the disputes between Harjit Kaur Siledar and her husband Mr. Ravindra Sing Siledar have been duly settled and Harjit Kaur has herself in open Court confirmed the same pursuant to which criminal writ petition no. 201 of 2019 and criminal writ petition no. 1452 of 2021 came to be disposed of. Subsequently, when the present applicant and the legal heirs of Late Mr. Trilok Singh Kartar Singh Siledar, approached the Ld. District Collector for removal of the seal of attachment, it was informed that the office of Ld. District Collector would require orders from the Hon'ble High Court for removal of the attachment over property situated at CTS No. 17007."

2 967.Crl.APPLN.1552.24.odt 3.

The learned counsel for the applicant submits that now the matter between respondent Nos.1 and 5 has been settled but the attachment on the property of the applicant remained as it is. According to him the applicant had approached respondent No.4 on various occasions to release his property but respondent No.4 is seeking direction from this Court. When the matter is settled between respondent Nos.1 and 5 and the attachment was only in respect of arrears of maintenance of respondent No.5, then after the matter is settled between respondent Nos.1 and 5 the respondent No.4 - Collector should have released the property of the applicant by taking necessary steps. Therefore, we deem it appropriate to request the learned APP to take instructions as to why despite settlement between respondent Nos.1 and 5, respondent No.4 - Collector refused to release the property.
