DATE : APRIL 08 2026 PER COURT :- Mr.M.G.Kochar, learned counsel for the respondent, submits that despite giving an undertaking before this court on 29.09.2025, the applicant has not deposited a single rupee.

The record shows that when the matter was listed on 17.10.2025, none had appeared for the applicant. On 03.12.2025, the learned counsel then appearing for the applicant has withdrawn his Vakilpatra. Notice was issued to the applicant, making it returnable on 24.12.2025. Thereafter, on 08.01.2026, the matter was listed before this court when this court recorded that the interim relief was operating against the respondent and directions to deposit the amount were not complied with by the applicant. It was also observed that on
12-sr916 the next date, if the amount is not deposited, the interim relief shall stand vacated. The matter was posted on 02.02.2026. The matter was then listed on 02.02.2026 when this court noted that the notice issued by this court to the applicant returned unserved as the applicant was not found on the address which he himself had mentioned in the title clause. Bailable warrant was issued in the tune of Rs.1000/- against the applicant, returnable on 04.03.2026. Thereafter, the office record reveals that bailable warrant was issued against the applicant. Report is received wherein it is stated that entry was taken in the concerned register but it is not stated whether the warrant is executed or not. Thereafter, on 25.03.2026, the matter was listed when nobody appeared for the applicant. It appears that the applicant has lost his interest in prosecuting the present Criminal Application. In view of this, the application stands dismissed for default.
