This is an Application for condonation of 134 days delay caused in preferring the Application for Leave to Appeal. 2.

Learned Advocate for the Applicant submits that, sufficient reasons are mentioned in the Application in support of delay and the Application be allowed.

Application is opposed by the learned Advocate for the sole Respondent. He submits that no sufficient reasons are shown in support of the delay and submits that the Application be rejected. 4.

Perusal of the Application shows that the following grounds are raised in the Application, which caused delay. "Applicant submits that previous criminal application for leave to appeal filed by complainant no. was EC-HCBMO3-06681-2024 it was filed online on 28th of April 2024. After filing the application there SG Punde

2 959APPLN4214.2024.odt was office objection for 2 (two) days delay, applicant is prepared to file delay condonation application meanwhile Summer vacations started therefore office objections was unable to clear. Applicant is about to file delay condonation application but meantime the online site of Bombay High Court was changed due to that the objections pending in online system was erased or deleted due to transfer to portal 3.0 update. When applicant went to take information in registry, he came to know that the previous pending record can not recollected again. Therefore, applicant need to file present delay condonation application with present petition including the delay from thereafter. The screen shot copy of online pending application the annexed herewith as Exhibit-A." 5.

In view of the above, the Application is allowed in terms of prayer clause 'A'.
