This order is passed after hearing both counsel including submissions of Mrs. 3 Gunjal on behalf of Respondent. 2.

Mrs. Gunjal, learned advocate for Respondents would draw the Courts attention to the earlier order dated 16 June 2025 wherein certain directions were passed. It is submitted by the learned counsel for the parties that the application for restoration against the order dated 3 August 2022 passed in Petition E-No. 31/2021 is pending before the Trial Court i.e., Family Court at Dhule as Criminal Miscellaneous Application No. 6/2023. Let this be decided by the Family Court at Dhule in accordance with law on its own merits as and when it is either circulated or listed before the Court. 51-Cri Appln-4687-2024.odt

It is further submitted that by an order of this Court dated 25 April 2025, there was a stay to the impugned order dated 3 August 2022, subject to certain conditions including regular payment of Rs. 4,000/- per month. Such conditions in the order of 25 April 2025, have been complied with by the Applicant. In the given facts and circumstances, it would be just and proper to direct that such arrangement by the order dated 25 April 2025 shall continue until further orders passed by this Court.

The Respondent is at liberty to file an Affidavit to the Criminal Revision Petition (Stamp) No. 12810/2024 on or before the adjourned date of hearing and serve copy of the same in advance to the learned advocate for the Applicant 5.

List the proceedings for further consideration/hearing on 18 August 2025.
