This application is for condonation of delay of 86 days in presenting criminal appeal, challenging order of rejection of regular bail.

Learned counsel for the applicant submits that for the reasons stated in paragraph no.2 of the application, it is desirable to condone the delay and to consider appeal on merits. Learned counsel for the Respondent No.2 vehemently opposes the prayers for condonation of delay.

There is no reason to doubt the grounds mentioned in paragraph no.2 of the application for condonation of delay. It's a matter of liberty of a citizens and I propose to adopt a pragmatic view. This Court has already considered the appeal of co-accused on merits. Hence, I am inclined to allow the application. 4.
