This writ petition is filed under Article 226 of the Constitution of India, seeking quashing of FIR bearing Crime No. 0006/2024, registered at Shivajinagar Police Station, Latur, District Latur, for offences punishable under Sections 498-A, 323, 504, and 506 read with Section 34 of the Indian Penal Code and the consequential Charge-sheet culminated in the registration of R.C.C. No. 521 of 2024, which is pending before the learned Judicial Magistrate First Class, Latur.

The crime has been registered on the basis of a report lodged by Supriya Nivrutti Bangarge, who is the wife of Petitioner No. 1. It is the prosecution's case that, the Informant married Petitioner No. 1 on 24.04.2019. At the time of marriage, her father gave Rs. 11.00 lakh, 15 tolas of gold, and other household articles, and all the expenses were borne by her parents. Her in-laws had informed her that, they owned a residence in Pune. Since Petitioner No. 1 was working in Pune, she went to reside with him there. She was treated well for a period of one month. Petitioner No. 5, Aayodhya, the married sister of her husband, was residing separately in Pune. At the instance of her sisters-in-law, Petitioner No. 1, husband, demanded Rs. 15.00 lakh from her parents for the purchase of a flat. From time to time, she was abused and
3 914CrWP483.2024.odt assaulted. On 09.09.2019, Petitioner No. 1 brought her to their native place on the pretext that his father had met with an accident. At that time, the Petitioners demanded Rs. 15.00 lakh, and she was assaulted. On 19.09.2019, she was again assaulted by her in-laws, and a demand for money was made. Thereafter, the informant went to her parental home. After some days, she was taken back to her matrimonial home but the harassment continued. On 04.12.2021, she gave birth to a baby girl. On 19.03.2022, which was the day of Holi, her in-laws demanded money, assaulted her, and threatened her with dire consequences, after which she was again sent to her parental home. On 14.10.2023, the Petitioners, namely her husband, mother-in-law, and brother-in-law, came to her parental home and stated that they would take her back only if Rs. 25.00 lakh was paid. As there was no change in the behaviour of the Petitioners, she lodged the report.

The learned Advocate for the Petitioners, upon instructions, seeks to withdraw the Petition to the extent of Petitioner No. 1, husband, namely, Nivrutti Dattatray Bangarge, and Petitioner No. 3, brother-inlaw, namely, Dnyaneshwar Dattatray Bangarge. Accordingly, the present Petition stands disposed of as withdrawn to the extent of Petitioner Nos. 1 and 3.

Heard the learned Advocate for the Petitioners, the learned Advocate for Respondent No. 3 - Informant, and the learned APP for the
4 914CrWP483.2024.odt State. With their assistance, perused the papers on record. 5.
Insofar as the remaining Petitioners are concerned, upon perusal of the FIR lodged by Respondent No. 3-Informant, on the basis of which the aforesaid crime has been registered, it is clear that omnibus allegations are made against them. The Petitioner No. 5 is undisputedly the married sister of Petitioner No. 1, husband, and is residing separately in Pune. Petitioner No. 4 is the wife of Petitioner No.3 i.e. the brother-in-law of the Informant. Although the informant has mentioned specific dates in the FIR, the allegations against the Petitioner No. 2, Vithabai Dattatray Bangarge, Petitioner No. 4, Shaila Dnyaneshwar Bangarge, and Petitioner No. 5, Aayodhya Shrinivas Manale, are not specific and are omnibus in nature. For the aforesaid reasons, making Petitioner Nos. 2, 4, and 5 to face the trial on the basis of such omnibus allegations would amount to an abuse of the process of law. Hence, the proceedings deserve to be quashed to their extent. Accordingly, the following order is passed:-
ORDER
[i] The Petition is allowed to the extent of Petitioner Nos. 2, 4 and 5.
[ii] The FIR bearing Crime No. 0006/2024, registered at Shivajinagar Police Station, Latur, District Latur, for offences punishable under Sections 498A, 323, 504, and 506 read

No. 521 of 2024, which is pending before the learned Judicial Magistrate First Class, Latur, is quashed and set aside to the extent of Petitioner No. 2, Vithabai Dattatray Bangarge, Petitioner No. 4, Shaila Dnyaneshwar Bangarge, and Petitioner No. 5, Aayodhya Shrinivas Manale.
