Heard the learned counsel for the applicant and the learned counsel for the respondent.

The respondent/complainant is present before the Court. 3.

The respective learned counsels made a statement that amount of the cheque and compensation has been paid to the respondent/ complainant. The complainant has no grievance against the accused. They wish to compound the offence. 4.

In view of compounding of the offence, the following order is passed:-

ORDER

i) The judgments and orders of the learned Additional Chief

971-CrRn-245-24.odt Judicial Magistrate, Court No.5, Aurangabad in S.C.C.No.8697 of 2019 dated 16.03.2023 and the learned Additional Sessions Judge, Aurangabad, in Criminal Appeal No.73 of 2023 dated 12.08.2024 stand quashed and set aside as the offence is compounded.

ii) The applicant/accused has been acquitted of the offence punishable under Section 138 of the Negotiable Instruments Act.

iii) Since the applicant/accused is in jail, he be released forthwith.
