After hearing learned Counsel for both sides, though learned Counsel for the Appellant has sought to make submissions with regard to the merits of the case, in view of this Court since the trial of the matter is at fag end and at the stage of recording statement of accused under Section 313 CrPC, it would not be appropriate for this Court to evaluate evidence accepting or rejecting the contention of the Appellant. Only for this reason, this Court has shown its disinclination. It is clarified that disinclination is not on merits.
