Heard learned counsel for the appellant. He submits that he has no instructions to appear for the appellant / accused. 2.
This Court, vide its order dated 22nd January, 2026 has already observed that the appellant / accused is in jail and the matter can be worked out in the third week of February 2026. In the morning session, I have heard learned A.P.P. at length. Since the learned counsel for appellant submitted that he is not in a position to appear, he may take appropriate steps for discharging himself.

In the meanwhile, considering the fact that the sentence imposed on the accused / appellant is of ten years and he has already undergone two 1 / 2
