1. Office noting dated 17.02.2026 indicates that the Respondent Nos.1 and 3 have been duly served through affixation in presence of two witnesses.

2. The learned Advocate for the Applicant submits that the 24th March, 2026

25 CRMA 19 2025 Respondent No.2 has expired during the pendency of the learned Trial Court proceedings and the same is reflected in the cause title of the application for condonation of delay bearing Criminal Miscellaneous Application No.19/2025.

3. Heard the learned Advocate for the Applicant.

4. This is an application for condonation of delay. On behalf of the Applicant it was submitted that there is a delay of 13 days in filing the leave to Appeal. Considering the reasons and grounds set out in paragraphs 5, 6 and 7 of the application, the Applicant has made out a case for condonation of delay. The delay is neither willful nor negligent and attributable to genuine reasons beyond the control of the Applicant.

5. In view thereof, the application for condonation of delay deserves to be allowed.

6. Consequently, Criminal Miscellaneous Application No.19/2025 is allowed and stands disposed of in the aforesaid terms. De-tag the Application.

7. List the Criminal Appeal No.1038/2024/(F) along with the application for Leave to Appeal, for arguments on 21.04.2026. ASHISH S. CHAVAN, J.
