The petition challenges the order dated 22.08.2023 in Petition No. E-387/2017 passed by the Family Court, Nagpur thereby granting the maintenance of Rs.2,000/- per month to each of the respondents from the date of filing of the application.

The contention is that the respondent no.1 herself has left the society and she is not ready to cohabit with applicant. The petition under Section 9 of the Hindu Marriage Act filed by the applicant was allowed. In appeal filed by the respondent no.1, there was settlement. In spite of settlement in the appeal, she did not join the company of the applicant.

Issue notice to the respondent, returnable within two weeks.
