It is common ground that by the common judgment the Family Court, Nagpur has decided the application for grant of maintenance under Section 125 of the Code of Criminal Procedure as well as petition for divorce filed by the applicant.

It is contended that the appeal against part of the judgment i.e. against dismissal of divorce petition is pending before the Division Bench of this Court. It is contended that the applicant will take steps for clubbing both the matters. 3.
