1. Heard the Applicant in person.

2. Challenge in the present Petition is only against the remarks of the learned Additional Sessions Judge which are found in paragraph No. 17 onwards in the impugned order and also imposing costs while disposing of the said appeal.

3. Applicant would submit that though, he is not challenging the observations or outcome of the Appeal, his challenge is only against such remarks of the Court against him which would cause great prejudice to him in matters which are pending before the Executing 20th August, 2024

CRMA 61 of 2024 Court.

4. Notice could be issued against the Respondents only with regard to the contentions now raised for expunging such remarks as well as the request for setting aside the costs awarded to the Respondents.

5. The parties are put to the notice that the Petition would be disposed of at the admission stage itself as grievance is restricted to the Applicant himself as discussed above.

6. Apart from the regular mode of service, other mode of service is permitted, including Registered Post A.D.

7. The operative order with regard to the costs passed by the First Appellate Court is stayed till the next date.

8. Stand over to 12.09.2024.
