1. Learned Counsel for the Petitioner states that Petitioner No. 1 has passed away on 30.09.2026. In view thereof, liberty is granted to the Petitioners to delete the name of Petitioner No. 1 from the cause title of the Petition. Amendment to be carried out forthwith. Re-verification is dispensed with.

2. Heard the learned Counsel for the Petitioners. It is submitted that the learned Deputy Collector & SDO/SDM, Pernem has issued notice under Section 107 of the Code of Criminal Procedure, 1973. He submits that the notice issued by the learned Deputy Collector & SDO/SDM is not in conformity with the provisions of Section 111 of the Code, and it is mandatory to pass an order in writing before the issuance of notice under Section 107 of the Code. 26th March, 2026

3. Issue notice to the Respondents, returnable on 09.04.2026. In addition to the regular mode of service, the Respondents may also be served by Speed Post, Courier, WhatsApp and Email. Affidavit of service along with the tracking report of the Speed Post, print out of the Email and WhatsApp message as proof of service to be filed by 06.04.2026. The Registry to provide the tracking number under which the Speed Post has been sent to the Respondents in order to enable the Petitioners to track the same.
