1. The Registry to waive the office objections, if any and register the Petition.

2. The Respondent though served, none appears for the Respondent.

3. Heard the learned Counsel for the Petitioner.

4. By the present Petition, the Petitioner has challenged the order dated 24.10.2024 passed by the learned Sessions Judge, by which, the learned Sessions Judge has directed the Petitioner to deposit a sum of Rs.50,000/- towards costs, which was imposed by the Trial Court.

5. On perusal of the impugned order dated 24.10.2024, I find that the order is not justified. Therefore, the order dated 24.10.2024 is quashed 23rd April, 2026

3 WPCR 121 2026 and set aside. However, it is made clear that if the Appeal of the Petitioner is dismissed, the Petitioner shall deposit the costs of Rs.50,000/- before the Trial Court as directed.

6. The learned Counsel appearing for the Petitioner undertakes to deposit such costs within a period of one week from the date of disposal of the pending Appeal.

This statement is recorded as an undertaking to this Court.
