The First Information Report was registered by Respondent No.2 for the offences under Sections 363, 376(2)(i) & (n) of Indian Penal Code and Section 4 of the Protection of Children from Sexual Offences, 2012 (POCSO Act).

The Petitioner and Respondent No.2 performed marriage. They are residing together as husband and wife. Respondent No.2 has attained the age of majority. Parties are seeking quashing of proceedings, by consent.

The issue whether the proceedings wherein the provisions of POCSO Act are invoked can be quashed by consent is pending before the Apex Court.
