The learned counsel for the Petitioner would submit before us that the charge-sheet filed pursuant to the F.I.R. being registered deserves to be quashed in the wake of a consensual relationship emerging between the two and the legal position supports the aspect that an offence under Section 376 of IPC would not be made out, if it is so established. 2.

In our opinion, this is a fit case, where the Petitioner should seek discharge, as now the charge-sheet is filed.

In the wake of the aforesaid, we dismiss the Writ Petition, with liberty to avail the remedy of seeking discharge before the competent Court.
