In this case, the trial has already progressed. The grievance of Petitioners is that inspite of the Consent Terms signed before the Civil Judge, Senior Division, Niphad, specifically mentioning the steps which the Respondent No. 2 had to take to withdraw the present criminal proceedings, which are the subject matter of this Petition, the Respondent No. 2 has not withdrawn the proceedings, but is strongly opposing quashing of those proceedings.

According to learned counsel for the Petitioners, she is harassing the Petitioners. However since the trial has progressed, learned counsel for the Petitioners seeks leave to withdraw this Petitioner with liberty to take appropriate steps against the Respondent No. 2 for not honoring her commitment made before the learned Civil Judge, Senior Division, Niphad in those proceedings.

The Petition is allowed to be withdrawn with such liberty. 4.
The Petition is disposed of accordingly.
