DATED : 15th SEPTEMBER, 2025 P.C. :- 1) This is a Petition for quashing of the F.I.R. and further proceedings arising out of the CR.No.I-115 of 2024 registered with Khadakpada Police Station, Kalyan on 26th January, 2024 under Sections 498-A and 420 of the I.P.C.

2) Though this Writ Petition is filed on merits of the matter, the parties were referred for mediation and fortunately the mediation is successful. Therefore, now the prayer is made orally for quashing by consent.

3) Learned Counsel appearing for the Respondent No.2 - Original First Informant has filed her consent Affidavit. It is taken on record. 4) In view of the Affidavit, it is not necessary to refer to the allegations in detail. Very briefly, the allegations were that the Petitioner 1/2

Manoj 8-WP-887-2024.doc and the Respondent No.2 got married on 8th June, 2023. However, the marriage could not be consummated and according to the first informant, the Petitioner was aware that the marriage would not be consummated. In spite of that he got married. On these allegations, the F.I.R. is lodged. 5) Now as mentioned earlier, the matter is completely settled between the parties. The Respondent No.2 in her Affidavit has stated that she has no objection for quashing of the F.I.R. in view of the Consent Terms which she had signed separately. The Consent Terms are part of the mediator's report tendered before this Court. 6) In view of this development, continuation of the prosecution will not serve any purpose. Therefore, in the interest of justice and in the interest of parties, the Petition can be allowed. Hence, the following Order :- :: ORDER ::

(i) The F.I.R. registered at Khadakpada Police Station, Kalyan vide C.R. No. I-115 of 2024 dated 26th January, 2024 under Section 498-A and 420 of the I.P.C. and further proceedings arising out of the same, are quashed and set aside. (ii) Petition stands disposed of.
