DATE : 3rd FEBRUARY 2026 P.C.:- 1) By this Petition, the Petitioner is seeking benefit of the Government Resolution dated 3rd June 2017, granting benefit in remission to the convicts undergoing sentence on 14th April, 2016. 2) It is an admitted fact on record that, the Petitioner is convicted by the trial Court by its Judgment and Order dated 10th July, 2019 and therefore the benefit of the said Resolution cannot be extended to him. The said issue has been clarified by the co-ordinate Bench of this Court at Nagpur in its Judgment dated 21st February, 2024, in Criminal Writ Petition No.857 of 2023, (Akash s/o Devanand Tempe vs. State of Maharashtra & 1/2

H.C. SHIV/KSG 40.w952.24.doc Anr.). It has been held that, the benefit of the said Government Circular cannot be given to a convict who was not in the prison on 14th April 2016. In other words, if a person was not convicted and behind bars on 14th April 2016, then he is not entitled to avail the benefit of the said Government Resolution.

3) In view of the above, we find there are no merits in the Petition and is accordingly dismissed.
