CORAM: BHARATI DANGRE & MANJUSHA DESHPANDE, JJ.

DATED : 18th SEPTEMBER, 2024 P.C:- 1.

We are apprised by Dr.Saraf, the learned Advocate General, that on re-consideration of the Rule, which had M.M.Salgaonkar

2/2 19 WP-3070-21.odt imposed a complete embargo for a person being released on parole, if he is not found eligible for being released on furlough, the draft amendment has already been circulated to the Law and Judiciary Department and we hope that, on adopting due procedure, this embargo may be relaxed.

We are happy to note that the State Government has also realised the effect of this Rule, which in fact amounts to an embargo for releasing the prisoners on regular furlough, which now has different criteria, which include the illness of near ones.

2.

Accepting the statement made by the learned Advocate General, we hope and expect the Law and Judiciary Department to complete the procedural formalities at the earliest.

Re-notify to 23/10/2024.
