At the outset, learned counsel for the Petitioner has filed rejoinder which is taken on record.

The direction issued by us on 02.07.2024, when we permitted the Petitioner to visit the daughter in Gwalior, has yielded some happy moments for the father and the child too. Chaitanya

2/2 905-Wp-1263-2024.doc Though the purpose of the Petitioner is served, and since we have noticed that the Supreme Court of the State of New York County of Westchester, have already put it seal on the Stipulation of Settlement and Agreement, subject to the rights available to the parties under the said arrangement, without prejudice to the said arrangement, we deem it appropriate that the Petitioner shall be permitted to meet the minor girl once in a month and as in the order dated 02.07.2024, we directed the Petitioner to visit Gwalior, where the Respondent No. 2 is residing with the child and upon his visit the custody of the child shall be handed over at 10.00 a.m. on a particular date, to be continued till 5.00 p.m., of the next date.

We are not indicating the dates of the visit and we deem it appropriate to keep it flexible. In addition, the Respondent No.2 shall also ensure that the video access is made available to the father every week as per the convenience of the child.

Writ Petition is disposed off.
