1) At the outset learned A.P.P. submitted that, in the present case charge has already been framed by the trial Court and the trial is in progress.

1.1) In view thereof, Mr. Mhaispurkar, learned counsel for the Petitioner seeks leave to withdraw the Petition with liberty to contest the Special Case No. 9 of 2023 pending on the file of learned Special Judge at Raigad, Alibaug.

1.2) Leave and liberty granted.
