By this petition sent through jail, the petitioner seeks expeditious disposal of his trial, since he is in custody for about 8 years i.e. since 2016.
Learned A.P.P, on instructions, states that the trial has commenced, inasmuch as, 12 witnesses have been examined till date and around 3-5 witnesses are left to be examined. 1/3
Considering that the petitioner is in custody since 2016 and having regard to the right of an accused under Article 21 of the Constitution of India for an expeditious disposal of his trial, the petition is allowed and the petitioner's case being Sessions Case No. 343/2016 (C.R. No.16/2016 registered with the Malwani Police Station, Malad, Mumbai), is expedited. Considering what is disclosed by the learned A.P.P that 12 witnesses have already been examined, we deem it appropriate to direct the learned Judge, before whom the case is pending, to conclude the same, as expeditiously as possible, and in any event, within four months from the date of receipt of this order.
Learned A.P.P to communicate the above order to the learned Judge before whom the case is pending, through the concerned Officer.
